CLASS ACTIONS LAWSUITS:
RICO ACT & RICO LAW
Passed in 1970, the Racketeer Influenced and Corrupt Organizations Act (RICO), is a law that provides for both civil and criminal causes of action for unlawful acts undertaken by an ongoing enterprise. RICO was initially instituted to prevent organized crime and its effect on legitimate business and trade. Common RICO violations include racketeering and an ongoing enterprise’s involvement with bribery, extortion, fraudulent pension and welfare funds, counterfeiting, embezzlement, mail and wire fraud, interference with commerce, money laundering, sales of illegal narcotics, loan sharking, illegal gambling, transporting stolen goods and other fraudulent and illegal activities. Today, the civil aspect of RICO dominates litigation, focusing on proving that a RICO violation caused damaged to the plaintiff’s property or business.
Wilentz attorneys have argued civil RICO cases in front of the United States Supreme Court and federal circuit courts, have litigated and tried RICO cases in district courts, and have been lauded by the courts for their extensive experience handling civil RICO cases. Wilentz attorneys have also authored many publications on civil RICO litigation, including sample civil RICO jury instructions published by the American Bar Association.
