Biographical Information:
Barbara G. Quackenbos is a shareholder with Wilentz,
Goldman & Spitzer on the Class Action Litigation Team. She has experience in a broad range of health care issues including reimbursement claims by major health care providers against state and federal agencies; managed care issues; fraud and abuse; contractual relations among providers and third parties; antitrust issues; and other administrative and regulatory matters.
After clerking for a year in federal court (Southern District of New York), Ms. Quackenbos prosecuted law reform litigation on behalf of senior citizens at the Legal Aid Society, Civil Division, in Brooklyn, NY. She also spent four years at Rosenman & Colin LLP in Manhattan representing large hospitals (including Health & Hospitals Corporation) and hospital associations on a wide array of matters. She researched and drafted pleadings involving hundreds of millions of dollars in reimbursement to hospital providers and hospital associations. She worked on many briefs involving ERISA, hospital reimbursement, bad debt and charity care and the Eleventh Amendment.
From 1998 until July of 2007, Barbara worked at Sills Cummis Newark. In addition to healthcare regulatory issues, her primary work involved litigation against health insurance companies. Specifically, she was one of the lead counsel in federal cases against United Healthcare (in NY) and against Health Net, CIGNA and others (in NJ) challenging the manner in which out of network reimbursement was paid to their subscribers in commercial plans nationally. In the litigation against Health Net, the federal judge (Faith S. Hochberg) has issued several opinions which have been cited in national press and leading treatises. In one opinion issued on December 6, 2006, Judge Hochberg issued an array of sanctions against Health Net, including adverse inferences and payment of attorneys' fees to Plaintiffs' counsel.
Ms. Quackenbos has represented clients before various state administrative agencies. In addition, she has provided material to several state legislatures to dissuade them from adopting regulations adverse to her clients.
