Persons exposed to asbestos products in the workplace also need
to know that important time and notice requirements apply regarding
workers' compensation claims.
Claims generally must be filed within two years of when a worker
was injuriously exposed to asbestos or other toxic substances at
work or within two years of when the worker first knew or should
have known he or she had a disease or condition caused by work
exposure or within two years of when the worker last received
workers' compensation benefits for the same problem. In addition,
there are also strict notice requirements that the employer be
notified of the work-related illness within 90 days if the worker
is still exposed and five months if no longer exposed. The notice
and time limitation rules are complicated, and discussion of all
the implications of these rules and exceptions to these rules
